Terms of Service

1. Description of the Service

Evermake provides tools to generate architectural renders from sketches and drawings using advanced rendering technology. Users purchase credits and spend them to request rendering tasks through our platform. Evermake is intended for legitimate architectural and design use and may not be used to generate prohibited or harmful content.

2. Eligibility

To use Evermake, you must:

• Be at least 18 years old
• Have the legal capacity to enter binding agreements
• Use the service in compliance with applicable laws

If you use the service on behalf of an organization, you confirm that you have authority to bind that organization.

3. Accounts and Authentication

Accounts are created using:

• Google OAuth login

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. We may suspend or terminate accounts involved in abuse, fraud, or violation of these Terms.

You may not use Evermake to generate or distribute:

• Illegal content
• Child sexual imagery or minors in any sexual context
• Deepfakes of real individuals without consent
• Graphic violence or extreme gore
• Hate speech targeting protected groups
• Content that violates intellectual property rights

All prompts are automatically moderated using OpenAI's moderation API before processing. Evermake reserves the right to reject any prompt that contains prohibited content, including but not limited to violence, sexual content, hate speech, or other harmful material. If your prompt is rejected, the generation will not be executed and credits will not be consumed. Additionally, all generated images and videos are moderated after creation. If generated content contains prohibited material, the content will be rejected and credits will not be restored.

You may also not:

• Attempt to reverse engineer or attack the service
• Abuse the system to create excessive load
• Use bots or automation to bypass normal usage patterns
• Attempt to circumvent content moderation systems

Violations may result in immediate account termination.

7. Analytics and Tracking

We use Umami, a privacy-focused analytics service, to collect anonymized usage data about how users interact with our platform. This helps us improve the service and understand user behavior. Umami does not use cookies and does not collect personally identifiable information. By using Evermake, you consent to this anonymized data collection.

8. Storage and Data Handling

Generated content and uploaded assets are stored in Supabase Storage. Metadata, prompts, credit history, and account information are stored in Supabase's database.

We do not guarantee permanent storage. We may delete old data to maintain system performance. It is your responsibility to download and back up your generated content.

9. Service Availability and Limitations

Evermake is provided "as is" and without warranty. AI model behavior is probabilistic and results may vary. We do not guarantee:

• Continuous uptime
• Specific output quality
• That generated content will match your expectations
• That the service will be free from errors or interruptions
• That AI-generated results will be suitable for your intended use
• That results will accurately interpret or represent your input sketches or prompts

AI-generated content is inherently unpredictable and may produce unexpected, unsatisfactory, or undesirable results. The quality, accuracy, and aesthetic appeal of generated content can vary significantly between generations, even with identical inputs. We are not responsible for and cannot control the subjective quality or artistic merit of AI-generated outputs. If you are dissatisfied with the results of a technically successful generation, we cannot provide refunds or regenerate content at no cost.

We may change, pause, or discontinue features at any time.

10. Limitation of Liability

To the maximum extent permitted by law:

• Evermake is not liable for any indirect, incidental, or consequential damages.
• Our total liability is limited to the amount you paid to us in the last 3 months.
• We are not responsible for losses resulting from AI model behavior, lost data, or misuse of generated content.
• We are not liable for dissatisfaction with AI-generated results, including but not limited to quality, accuracy, aesthetic appeal, or failure to meet subjective expectations, provided the generation completed without technical errors.

Some jurisdictions may not allow certain disclaimers; in those cases, the limitations apply to the maximum extent allowed.

11. Termination

We may suspend or delete accounts that:

• Violate these Terms
• Abuse the platform
• Engage in illegal activity
• Attempt to exploit the system

You may close your account at any time. Upon termination:

• Access to the platform ends immediately
• We may retain transaction records for legal and fiscal purposes

12. Changes to These Terms

We may update these Terms periodically. When changes are made, we will update the "Last updated" date. Continued use of the platform after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by applicable international contract principles. Specific jurisdiction may depend on your country of residence and on regulatory requirements of Polar as merchant of record.
